Application: SA EMS Road Experience (incorporating the Road-Tested Field Guide & Offline Pocket Guide)
Jurisdiction: Republic of South Africa | Last Updated: September 2026
⚠️ CRITICAL CLINICAL NOTICE: This application is a decision-support, cognitive reference, and training simulation tool for healthcare professionals and students. It does not provide autonomous diagnostic direction, automated prescriptions, or medical advice. Use of all assessment scoring tools, calculators, drug monographs, and algorithms is strictly at the clinician's own risk and discretion.
1. Guest-First Access & Binding Acceptance
- 1.1. Open-Access Architecture: The SA EMS Road Experience ("the Application", "the Service", "the Platform") operates on an open-access model allowing clinicians and students to browse educational algorithms, protocol pathways, and clinical scenario previews without requiring upfront user account registration.
- 1.2. Deemed Acceptance by Conduct: By accessing, opening, browsing, querying, running local calculations on, or caching this Application on any mobile device or browser, you ("the User", "Clinician", "Student") unconditionally agree to be legally bound by these Terms of Service. If you do not agree to these terms, you must immediately terminate use of the Application.
2. Statutory Independence & Non-Affiliation Notice
- 2.1. Independent Companion: This Application is an independently authored educational companion and clinical decision-support reference developed by registered emergency care practitioners.
- 2.2. No Statutory Endorsement: This Application is NOT owned by, operated by, developed in partnership with, or officially endorsed by the Health Professions Council of South Africa (HPCSA), the Professional Board for Emergency Care (PBEC), the University of Cape Town (UCT), or The Health Foundation of South Africa (NPC).
- 2.3. Statutory Precedence: All references to the Clinical Decision Support Tools (CDST Version 1.3), the List of Capabilities and Medications (Annexure A, April 2022), and the Clinical Practice Guidelines (2018) are strictly descriptive and educational. The official gazetted and published guidelines of the HPCSA PBEC remain the sole statutory and clinical governance baseline in South Africa.
3. Clinical Calculators, Assessment Tools & Independent Verification
- 3.1. Clinical Calculators & Scoring Systems: The Application provides digital calculation and clinical risk-stratification tools, including but not limited to:
- Weight-based pediatric and adult drug dosage calculators (e.g., mg/kg, mcg/kg, infusion rate conversions);
- Fluid resuscitation formulas (e.g., Parklands burn calculations, pediatric bolus guides);
- Clinical triage, neurological, and trauma scoring tools (e.g., GCS, Revised Trauma Score, Wells Score, SATS triage thresholds).
- 3.2. Strict Use at Own Risk: All clinical calculations, score outputs, and algorithm results are utilized at the User's sole risk. Mathematical rounding, digital conversion variances, user input errors, or platform updates can influence numeric values. No software calculation should ever bypass manual human verification.
- 3.3. Mandatory Independent Verification: Before preparing, drawing up, or administering any medication, setting an infusion pump, or executing an invasive procedure on a live human patient, the attending practitioner is strictly required to independently verify all calculations, drug concentrations, unit conversions, and dilution protocols against local clinical governance guidelines, employer Standard Operating Procedures (SOPs), and official HPCSA documentation.
- 3.4. Sole Practitioner Liability: The treating clinician remains individually, professionally, and legally liable under South African law for their patient assessment, procedural execution, and all administered pharmacological agents.
4. Scope of Practice & Statutory Compliance
- 4.1. Strict Scope Boundaries: The User acknowledges that healthcare practitioners in South Africa are legally restricted to practice strictly within their registered qualifications (BAA, AEA, ECA, ECT, CCA, NDip, ANT, ECP).
- 4.2. No Authorization Conferred: Reviewing an advanced algorithm, calculating an advanced inotropic infusion, or completing an RSI simulation module within this Application does not confer, imply, or grant legal authorization to perform procedures or administer medications outside the User's registered HPCSA scope of practice.
- 4.3. Ultra Vires Acts: The Author and Developer accept zero liability for any practitioner who acts beyond their lawful scope of practice or engages in clinical negligence.
5. Purchases, Universal Email Sync & Device Recovery
- 5.1. Product Tiers:
- Open Tier: Free access to foundational clinical search, primary algorithms, and introductory case previews.
- Monthly All-Access Pass (R50 / month): Grants ongoing recurring access to all current and upcoming clinical packs, advanced features, and updates.
- Modular Case Packs (R50 once-off per pack): Unlocks permanent access to a specific 10-case clinical study deck (e.g., Trauma, Airway, Cardiology, Obstetric Emergencies).
- Offline Master Pocket Guide (R250 once-off): Grants permanent offline access to the complete consolidated drug and protocol pocket guide.
- 5.2. Email as Universal Restore Key: In accordance with our guest-first architecture, no password creation is required upfront. When completing any transaction, the User provides a valid email address. This email acts as an encrypted Universal Restore Key. In the event of a lost, damaged, or replaced mobile phone, or cleared browser data, entering this verified email via the "Sync / Restore Access" feature instantly restores all active licenses.
- 5.3. Offline Caching & Storage: Offline features operate via local device browser cache (IndexedDB and Service Workers). Clearing browser caches or operating in incognito modes without a linked email may reset local data until restored.
- 5.4. Refund Policy: Due to the immediate delivery of digital clinical tools, downloadable reference guides, and offline asset caching, all digital sales (once-off packs and offline guides) are non-refundable once delivered, in accordance with the South African Consumer Protection Act 68 of 2008.
6. Absolute Limitation of Liability & Indemnity
- 6.1. "As-Is" Provision: The Application, its calculators, clinical cards, algorithms, and databases are provided on an "as-is" and "as-available" basis without warranties of any kind.
- 6.2. Comprehensive Waiver: To the maximum extent permitted by South African law, in no event shall the Developer, Author (Jacoline Geldenhuys, BEMC), clinical contributors, or technical partners be held liable for any direct, indirect, special, incidental, consequential, or punitive damages whatsoever. This includes, without limitation, patient death, personal injury, adverse drug reactions, misdiagnosis, calculation errors, hardware failure, or operational delays arising out of the use of this software.
- 6.3. Indemnification: The User agrees to indemnify, defend, and hold harmless the Developer and Author from and against any third-party claims, malpractice lawsuits, HPCSA disciplinary hearings, legal costs, or liabilities arising directly or indirectly from the User's clinical conduct, patient interventions, or reliance on the software.
7. Intellectual Property & POPIA Privacy
- 7.1. Software IP: The deterministic search engine algorithms, custom dark-mode HUD layouts, UI assets, and clinical scenario narratives are the proprietary intellectual property of Jacoline Geldenhuys.
- 7.2. AI-Generated Visualizations: All visual scenario cards, 3D anatomical models, and clinical illustrations are AI-generated conceptual designs and do not depict real patients, live casualty scenes, or confidential clinical records.
- 7.3. POPIA Compliance (Act 4 of 2013): The Application collects minimal personal identifiable data (email address on purchase/waitlist) solely for billing authentication, restore syncing, and product updates. Users are strictly prohibited from uploading or inputting real-world patient records, hospital numbers, or un-anonymized clinical data.
8. Governing Law & Severability
- 8.1. Governing Law: These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of South Africa. Any disputes shall fall under the exclusive jurisdiction of the South African courts.
- 8.2. Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
